This regulation aims to define the conditions related to the civil liability declaration for minors participating in our karting activities. It is designed to ensure the safety of minors and comply with legal requirements regarding civil liability in the practice of karting.
1. Definition of Civil Liability for Minors
Civil liability for minors refers to the legal obligation to compensate for any damages caused by a minor to a third party. In the event of damage occurring during karting activities, this liability primarily falls on the parents or legal guardians of the minor.
2. Mandatory Declaration for Minors
Before registering a minor for a karting session, parents or legal guardians must complete and submit a civil liability declaration. This declaration is required to allow the minor’s participation in the activity.
3. Content of the Declaration
The civil liability declaration must include the following information:
- Minor’s full name
- Minor’s age (date of birth)
- Name and contact details of parents or legal guardians
Certification that the minor is covered by a civil liability insurance policy, either personally or through their parents or guardians
Signature of the parents or legal guardians, confirming their commitment to cover any civil liability in case of damage caused by the minor during karting activities
4. Civil Liability Insurance
It is the responsibility of the parents or legal guardians to subscribe to a civil liability insurance policy covering the risks associated with karting. They must ensure that this coverage remains valid for the duration of the karting session in which the minor participates.
5. Failure to Provide the Declaration
If the civil liability declaration is not submitted before the minor participates in a karting session, they will not be allowed to take part in the activity. No refunds will be issued in this case.
6. Limitation of Liability
The establishment cannot be held responsible for damages caused by a minor during karting activities or within the premises, provided that the minor’s civil liability is appropriately covered by an insurance policy subscribed by the parents or legal guardians. The parents or legal guardians acknowledge that the establishment takes all necessary measures to ensure the
safety of participants but cannot be held liable for any accidents or incidents occurring during the session.
7. Modification of the Regulation
This regulation may be modified at any time in response to changes in legislation or specific requirements of the activity. Any modification will be communicated to the parents or legal guardians of minors enrolled in our activities.
8. Applicable Law
This regulation is governed by the laws in force in the country where the karting activities take place. In the event of a dispute, the parties agree to submit their case to the competent legal authorities.
Before a minor can participate in a karting session, parents or legal guardians must accept this regulation and submit the civil liability declaration. This ensures both the safety and legal compliance of the activities offered at our facility.
